1. Acceptance of Terms

By accessing or using OdyrAI ("the Platform", "we", "us", or "our") at odyr-ai.vercel.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

OdyrAI is a marketplace platform that allows sellers to list and sell AI-generated digital products (including but not limited to: prompts, code snippets, templates, full applications, and APIs) and allows buyers to discover and purchase these products. Subscription plans are available for sellers who wish to list more than the free tier limit of products.

3. User Accounts

You must create an account to sell products or make purchases on OdyrAI. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account.
  • Keep your login credentials secure and not share them with others.
  • Notify us immediately of any unauthorized use of your account.
  • Be at least 18 years old or have parental consent to use the platform.

4. Seller Responsibilities

As a seller on OdyrAI, you agree to:

  • Only list digital products that you have the right to sell.
  • Provide accurate descriptions of your products.
  • Ensure your products are functional and as described.
  • Have a valid PayPal account to receive payments from buyers.
  • Not upload malicious, harmful, or illegal content.
  • Not infringe on any third-party intellectual property rights.

5. Payments and Subscriptions

Product purchases: When a buyer purchases a product, the payment of $2.00 is made directly to the seller via PayPal. OdyrAI does not collect any commission on product sales. Buyers are subject to PayPal's standard fees.

Free products: Sellers may list products at $0.00. Buyers can claim free products at no cost.

Seller subscriptions: Subscriptions (Pro at $5/month and Business at $10/month) are billed through Paddle and renew automatically each month. You may cancel at any time from your account settings. Access continues until the end of the current billing period.

6. Prohibited Content

You may not list or sell products that:

  • Violate any applicable law or regulation.
  • Infringe on intellectual property rights of third parties.
  • Contain malware, viruses, or harmful code.
  • Are pornographic, obscene, or sexually explicit.
  • Promote hate speech, discrimination, or violence.
  • Are fraudulent, misleading, or deceptive.

7. Intellectual Property

Sellers retain ownership of their products listed on OdyrAI. By listing a product, sellers grant OdyrAI a non-exclusive license to display and promote the product on the platform. The OdyrAI name, logo, and platform design are the intellectual property of OdyrAI and may not be used without permission.

8. Disclaimer of Warranties

OdyrAI is provided "as is" without warranties of any kind. We do not guarantee that the platform will be uninterrupted, error-free, or that any products sold by third-party sellers will meet your expectations. Buyers should review product descriptions carefully before purchasing.

9. Limitation of Liability

To the maximum extent permitted by law, OdyrAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform or any products purchased through it. Our total liability shall not exceed the amount paid by you to OdyrAI in the three months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms of Service. You may also delete your account at any time from your profile settings. Upon termination, your right to access the platform ceases immediately.

11. Changes to Terms

We may update these Terms of Service from time to time. We will notify you of significant changes by posting the new terms on this page with an updated date. Continued use of OdyrAI after changes constitutes acceptance of the new terms.
